Some Feedback Here: How Can One Patent An Idea? email this discussion to a friend?

myLot reputation of 99/100. pyewacket (7602)   ranked 40 out of 23,971 in life2 months ago

As some know I had to "change my plans" the other day since I came with a bout of carpal tunnel which really hurts like shat. I hadn't had that in a long time, and I never resorted to using a brace type thing like most people do when they have it, nor did the idea of surgery wow me.

Instead I have my own tried and true method of "healing" it and as you can tell, my carpal tunnel is healed otherwise I wouldn't be up and running again not only typing here, but earlier I typed out an article.

My own method of healing my carpal tunnel involves using my own herbal compress, plus an ointment then just wrap everything around my palm of my hand and wrist with an elastic bandage. And I swear it works wonders..in fact I've also used my herbal compress for a host of other things and works as well.
So I was mentioning this to a friend of mine her and kidding that gee, maybe I should patent this idea and that would be my road to fame and glory and money....LOL

The thing is...how could one seriously patent such an idea? It's not exactly an "invention" and since it's a basically herbal remedy I've concocted it isn't a "medical" cure or FDA approved kind of thing...but seriously..how can an idea like this be patented???

Any ideas???

The first thing I would do is contact a patent lawyer. They can be expensive but the initial phone call shouldn't cost too much. This might be your best bet.

myLot reputation of 99/100. pyewacket (7602)   ranked 40 out of 23,971 in life  2 months ago

Well forget a lawyer...I'm on SSI benefits and a lawyer would be a real expense for me. I plan to hunt around the web see if I find anything though

myLot reputation of 80/100. hornswaggled (848)   ranked 1,060 out of 23,971 in life  2 months ago

You might just call the lawyers office and ask if they can give some advice for free. I have never been charged for a phone call to a lawyer yet. Except after I hired them for something. They might also be able to direct you to some free legal advice clearinghouses. Good luck!

I don't think you could...

1) You cannot patent an idea. It has to be something concrete... and you need to be able to demonstrate that it works. They won't just take your word for it.

2) It is kind of a medical thing if you are talking about a cure. Which means more red tape that you could possibly handle... not talking about the whole medical fraternity who will object to it.

3) If you are using ingredients from other manufacturers to concoct your remedy... they already have a patent on those products... and they will want a percentage of your gains.

4) Even if you manage to get a patent for it... that is the easy part. Then you need the money to manufacture it in large quantities... advertise it and distribute it. By the time you paid all those people... as you cannot do it yourself... you'll be lucky if you are getting 10 cents profit per sale.

5) When you don't have the resources... the best way is to get the patent... and then sale the patent to a manufacturer... and make your profit that way. But finding the manufacturer is another story. The best people to do it would be the one who is already making the ingredients that you are using.

6) You could not sale something like that without the approval of the medical association. Even the manufacturer of the ingredients would need approval before making any public claim that your idea can cure people.

7) Who would you sale it to? People are too lazy to make compresses today. They want everything in the form of a little pill that they can swallow.

All in all... it is a bureaucratic nightmare. And a patent also cost money. Then you need to register a business... which cost more money... in order to sale your idea. Nobody wants you to get rich... and the way they keep you poor is by burying you under a pile of red tape.

myLot reputation of 99/100. pyewacket (7602)   ranked 40 out of 23,971 in life  2 months ago

Yeesh..why do I get the feeling that you have tried to or have patented something? Well my idea is not necessarily a bondfide "cure" anymore than wearing a brace for carpal tunnel is a cure, but it does relieve the pain. Uh, my herbal "cure" involves good ole fashion sage, yes sage so who has the patent for that..uh God...LOL? lol As far as the medical association approval..heck they don't approve any of the more natural remedies and think most are bogus anyway yet like gee, why do they work? But you're right in the sense that most people want a pill that they can swallow rather than go the extra mile to "brew" up something

Hi Pye! I sure wish I knew so I could tell ya but I don't but nonetheless, if it worked for you then why wouldn't it work for others, right? How in the world did you figure this out?! lol You must have a brilliant mind to think and actually make the concoction to begin with!! I wish I had a mind to do things - even remotely like that. lol I'd like to see you get a patent for it because it would help so many others! Good luck gal!!

myLot reputation of 99/100. pyewacket (7602)   ranked 40 out of 23,971 in life  2 months ago

My great-grandmother was a nurse who frankly thought most doctors to be idiots..LOL...she was a walking encyclopedia of natural and herbal cures and I must have somehow inherited that skill...I've often done herbal cures even for my kitties and have worked wonders too. So I guess I just have that knackwink

why not try googling it and asking what you have
said here. seems to me like there could be someplace
that would tell you how to patent an idea like that
and I think it well worth looking into. so many
of us are looking for herbalways to help various ills
and that should appeal to someone surely. any time
you can avoid surgery is so great if it works and
you are proof that it does. try it and see.

I like that idea you suggested about making a book out of my idea..sort of like an e-book??? I have other uses for my little miracle help...other than helping carpal tunnel. It might not be so much as a patent thing to think of..someone else here suggested trademarking the idea instead

Hi Pye, I just wanna say don't give up on your idea, and don't let no one else discourage you. Everything has a price, nothing is free. Another thing, taking a pill isn't always the answer. There are pills today on the market that has some really bad side-effects and can kill you. Some of them already has killed some people. People are more health conscious these days. More and more people are going to the health food stores and even ordering from health food stores. Do your homework, go to the library and do some research on "How to Patent your idea". Whatever it takes don't give up. At least try as hard as you can, go as far as you can go. If you stop now, maybe one day soon you'll look up and they will have what you wanted on the shelves. Think positive you will go far. That saying "If theres a Will theres a Way". It's true you know. I'm pullin for ya. You go get them Pye! Oh i almost forgot i don't know if you watch Ronnie Deutch he hosts a show called "The Big Idea", Watch it sometimes you will be amazed at the people that has brought their ideas to life, people from all walks of life and now they are set for life and some are on the road to getting there. It really is inspiring.

myLot reputation of 99/100. pyewacket (7602)   ranked 40 out of 23,971 in life  2 months ago

oh I know...I'm not a great medication taker precisely due to all the horrible side effects they have...like the recent thing about Chantrix the stop smoking med...now linked to people committing suicide!
What channel is The Big Idea on??? I've never even heard of it before. Not don't worry, if there is someway to get my idea out I will! and thanks ever for the encouragement!happy

myLot reputation of 64/100. Remmie7 (127)   ranked 2,749 out of 23,971 in life  2 months ago

Hello Pye, Forgive me for taking so long in getting back to you. I know I will get better in checking any responses that I get. I want you to go to Yahoo and enter the big idea with donny deutsch. when you get that web page, click on MSNBC-The Big Idea:Donny Deutsch Questions People in Business. When that page comes up click on the video (youtube) and hear and see what donny's show is all about. On the right side of the page there will be more to view. Check it out. That program is very motivating and Donny is great. Anybody can learn from watching the big idea. The city where i live it comes on channel 39. I would look in a tv guide or call the tv-station to see if and when on what days it comes on. We get it everyday at night at 9pm.and the again and encore at 12-midnight. Thanks for responding. See You At The Top!

myLot reputation of 99/100. pyewacket (7602)   ranked 40 out of 23,971 in life  2 months ago

Somehow I have the feeling though that you need cable to get the show??? I haven't had cable in years..had to cancel itsad

myLot reputation of 64/100. Remmie7 (127)   ranked 2,749 out of 23,971 in life  2 months ago

PYE, you can still look at the video's on the web to give you some idea of the show. You can also write to them. But I would be careful not to disclose your ingredients to anyone. Remember they are a big company with big money and they can get it done. I know there is a way for you to do the darn thing! I will do all that I can do to help you with information, I will even call the health food store to see what they can tell me. We all have Dreams, even me PYE. I don't want anything from you but for you to get this off the ground. I don't know what your religious beliefs are but i'm praying that you make it.

I don't think that it's possible. There are lots of things to consider and the end product may not be the same as the original one. However, there is no harm trying and asking a pro whether it works or not. But for herbal remedy, I think there are people that have tried. You just need to ask around those in this business. I think they should know more.

myLot reputation of 99/100. pyewacket (7602)   ranked 40 out of 23,971 in life  2 months ago

Well I do know that the medical profession kind of frowns on herbal remedies, even though they are just as effective if not more than medications that have so many harmful side effects it's not funny

I think even though it is a herbal remedy Pye,
You would still need to go through the FDA first.
I dont know for sure, but think you most likely will have to.
Only because because it is something you apply directly to your skin.
In the government section of your telephone directory you should find a listing for patents.

myLot reputation of 99/100. pyewacket (7602)   ranked 40 out of 23,971 in life  2 months ago

actually here the FDA really doesn't regulate any herbal remedy and frowns on them anyway thinking they're hogwash...even one of my own doctors one time..I was surprised since he was an Oriental person and thought he be "into" or be knowlegable about Chinese herbal cures that have worked for centuries and a lot less harmful than medication...so one time I mentioned some herbal thing to him and he scoffed at it saying "wives tales"--OH...??? Well my great-grandmother was a nurse thought all docs were idiots and she was into herbal cures...she lived to be 98
