cry After reading this whose side would you be on -- the lawyers or the airlines? Do you think it is fair to ask for $1 million from the Airlines or should he just ask for the extra money that it cost and punitive damages for the stress and inconvenience?

NEW YORK (May 28) - A New York City lawyer has sued Delta Air Lines Inc. for nearly $1 million, claiming the company's incompetent and rude employees made his 80-year-old mother's birthday trip to South America a stressful, costly horror. Attorney Richard Roth says not only did he and his family arrive in Buenos Aires, Argentina, almost three days late, he had to spend unplanned thousands of dollars on food, hotels and transportation, and buy tickets for another airline.

And because Delta misplaced his luggage, Roth's lawsuit says, he had to buy new clothes for himself and family members after arriving in Buenos Aires. Though he was promised Delta would bring his luggage, Roth says he had to drive to the airport in Buenos Aires to look for and retrieve his bags himself.

During the ordeal, Roth's court papers say, several Delta were "nasty," "rude," "obnoxious" and "totally disrespectful." Those who were courteous were generally ineffectual in assisting him, the court papers say.

A Delta spokeswoman, Betsy Talton, said Tuesday that she could not comment on pending litigation.

Roth, 49, of Scarsdale, N.Y., said he arranged for his mother to fly to her native Argentina during the 2007 Christmas holidays. He says he and his family were scheduled to fly from the Westchester County Airport the evening of Dec. 20.

Roth said he was with his mother, his wife and his teenage son and daughter. They were to meet a 20-year-old cousin in Atlanta and take a connecting flight to Buenos Aires where they would celebrate his mother's 80th birthday.

In Atlanta, say court papers filed Friday in Manhattan's state Supreme Court, a gate agent refused to let Roth and his family onto the jet for the connecting flight, although the plane was sitting at the gate with the door open.

Roth says his cousin, already on the plane, told him by cell phone there were several empty seats. When Roth asked the agent to speak to the pilot, he replied, "The pilot is not in charge here. I am. All the pilot does is fly the plane."

Roth's court papers say that after he and his family spent two nights in Atlanta, a ticket agent told him Delta could not get him to Argentina before Jan. 8. So they flew to Florida, spent a night there and took an Aerolineas Argentina flight to Buenos Aires after buying one-way tickets, court papers say. angry

Well it does seem like a silly thing when you see the headline. After taking some time to read it I noticed the part about gate agent. It doesn't say in there why they were refused entry at the gate. I'm betting that this guy didn't get a straight answer either. Due to this one moronic gate agent the whole trip went gaga. So it's not surprising that these people are really teed off. I mean heck travelling with an elderly person is stressful enough, never mind all the waiting you have to do. This is really pretty bad service. Unless they learn how to treat their paying customers in a civil manner I'm afraid they'll just have to put up with a lawsuit like this.

The sad part is, okay, he had a crappy experience. Do we recall those hundreds of people that sat on a closed airplane for hours and hours and got.... voila.. a free ticket? On one hand it's a bit extravagant for what happened but on the other it's frustrating and it seems to happen all too often so perhaps a good hit in the pocketbook would help them be a little more responsive.

Yet here I sit, unable to work after being in a car accident and because the man who hit us was a Federal Official he is exempt from any damages, etc. and it truly looks like in the court system, while we will win, we'll get pennies in the end. I'm disabled for life, get a couple thousand. He's inconvenienced and had a bad trip and gets millions? This is what's wrong with the court system in our society anymore. Priorities are to those who have the money to spend on completely ignorant stuff, hot coffee on a crotch warrants billions while someone is injured in a wreck and gets a couple thousand.

Jeesh, marilynut, what a story this is--about the inefficiency of an airline, in this case, Delta. I don't know where to start.

It is confusing because it sort of sounds like he and his family flew to Atlanta without actually having flight tickets for a connecting flight to Buenos Aires, and I just can't imagine that. I mean, think about how much money it would cost to just hang out at an airport or hotel close by until you could get that many seats on a flight out of the country, with no "lead time." At Christmastime, no less.

However, I do see the misplaced luggage as Delta's problem, for sure, although I wonder what you can actually do to be reimbursed.

Well, I am sure that a pilot does not have anything to do with who gets on/off of the plane, they are just the "driver" or "chauffeur." So, it makes sense that speaking to the pilot would not help whatsoever.

I'm feeling like the guy's demand for $1 million is pretty over the top, at least, given the info in your post. I mean, who would go to an airport and not already have tickets for their connecting flight, with several family members, flying out of the country, at Christmas time???!!

I would guess he might be able to get a little something for the lost luggage. Even in this case, there may be some sort of disclaimer included with flight tickets that we've not read. Jeesh, I guess I'm sort of siding with Delta in this particular case, based on this info.

After reading this here and viewing it briefly in the news, I believe he does have a case against Delta. For $1,000,000.00, NO!

If the lawyer is as accurate as it seems in the reading, he should be able to name/describe each Delta associate in court papers so that they can be held accountable for their actions. He should ask for damages fitting the crime.

It is a shame that an 80 yr. old lady had to go thru this.
