Are There Any Canadian Lawyers Out There? A Question About Making A Legal Will!I  |

 I'm a Canadian and my husband is an American. We want to settle up here in Canada, where I am now.
He will be here in a few months, and he told me he wans to make a new and final will up here in Canada.
Can anyone tell me if it is legal or an American to make a Will in Canada, if he is not a citizen? He is married to a citizen.
Any advice would be greatly appreciated.

My cousin is a lawyer. You should make a living will by going to a lawyer. Tell him/her what you want in it and then make sure that he tapes you saying it.
If your husband is going to live in Canada and has permission to enter the country as a landed emmigrate
he should be able to make a will in Canada.

I think if he is in Canada for a year after he gets a green card he is consider as someone who is going to be living in Canada.
I don't know the Province you are in and some, (ie.Quebec), have different laws. That is why I suggested you see a lawyer.
I do know if he owns property in the US and it is over $100,000.00 and he dies then their will be American tax on everything he owns...in Canada and the US. | |

So yes it would be legal for you both to make a will in Canada because you're married. Good Luck!!
