Sometimes anyway. I don't know if any of you remember, but my brother was in a very bad car wreck a little while back. He just found out today that the other person's insurance company isn't going to pay. His insurance company has to pay for his car, and he still doesn't know about the medical bills. The insurance investigator ruled it no contest or whatever you call it. Said it was each person's word against the other. The thing my husband and I don't understand is how it could NOT be the other guys fault when he turned across the highway and hit my brother. My brother was going straight down the highway and the other guy was turning from the turning lane. They are saying that both lights were green, but it shouldn't matter. His insurance should still have to pay because he failed to yield. I just don't get it. I'm glad my brother is healthy and I know that's the most important thing, but this is ridiculous.

KrauseHome (8819) | 5 months ago | Sometimes, it just has to be one word against another, and without any real witnesses to verify one thing or another, sometimes unfortunately you will see things happen like this. Even if they know it was their fault, but trying to make it look as if it was not. All I can say, is at least your brother is alright, and maybe not from this, but if you just look on the bright side of things, sometimes things do not always turn out the way you want them too, but usually the best comes out in the end as well.

sunnflr (695) | 5 months ago | Sometimes I'm sure it isn't anyone's fault. But if the other guy failed to yield the right of way then seems like he should have automatically been at fault. The police report says it's his fault but evidently that doesn't matter. I am glad my brother is ok. No amount of money is worth more than his health and life.

Right now I am STILL waiting for my insurance company to pay for my carpal tunnel surgery which I had in December. It was outpatient surgery and from the time I walked inside the hospital door until I walked out was all of 2 hours! The insurance company is fighting the hospital bill. I had called before hand to preapprove the surgery and they said it was not necessary because it was outpatient. Now they are telling me the hospital was supposed to preapprove it and they didn't. The hospital said they did. Now who do you think will be responsible in the end if they don't pay?! ME! Now why in the world would an insurance company deny a $2000 bill? That is nothing for them. They make millions! I have a friend whose brother died of cancer. He left her his house and possesions, thinking that everything would be paid for upon his death. NO! Basically the fine print said they would not pay if he died of an illness. The crooks! You trust them and then they worm their way out of paying for so many things! It just isn't right! I'm glad your brother is okay, but I agree with you that it is ridiculous how insurance companies act.

sunnflr (695) | 5 months ago | There is probably things out there that you could join to lobby for changes with the insurance companies. I'm sure you could write to the Insurance commisoner for your state and let them know what you think. If enough people did it they might make changes.

I often wonder if they just decide to make it easier on each one by splitting the costs evenly. Therefore, they just say both or neither were at fault, so each company pays half. Yes, the most important thing is that your brother recovered or wasn't hurt too badly, but still, dealing with insurance companies can make it pretty irritating.

The police report said it was the other guy's fault, but the investigator said because both lights were green it is no fault. My brother hasn't been able to work all this time, he could hardly walk for most if it, so has no money to fight with.

mentalward (2179) | 5 months ago | Since your brother was hurt to the point where he can't walk then I'd say he really should sue for not just medical bills, but punative damages as well! He can talk to a lawyer about this. Most consultations are free. It sounds to me like your brother has had enough pain and suffering to successfully win a lawsuit against the other driver. In these types of cases, the lawyers usually charge 1/3 of any money they recover and don't charge a penny if the case is lost. Instead of an hourly fee, they only get paid 1/3 of the judgment amount. Pain and suffering are worth quite a lot of money! It wouldn't hurt your brother to see a lawyer about this and quite possibly he could walk away with a nice, big check!

They do that because some people will not fight or argue their decision. Insurance companies are notoriously despicable! That guy hit your brother's car, right? The police report says the other guy is at fault. There is no doubt in my mind that your brother will win a lawsuit against that insurance company. Call some lawyers to find one who will charge 1/3 of the award (most will). That won't cost your brother a penny! Most will do this and, since the police report clearly states that the other guy is at fault, most will not hesitate to take this case. Don't let the insurance company win!

mentalward (2179) | 5 months ago | Dang! I keep forgetting things! Since your brother hasn't been able to work, if he can back that up with medical reports, he will most likely win an award, not only for the damage to his car and punatitve damages for his pain and suffering, but lost wages as well!

sunnflr (695) | 5 months ago | I will tell him your suggestions and that some lawyers don't charge up front. Then he can decide what he wants to do. As far as work goes, he worked for himself buying and selling things. He has no way of proving how much he would have made while out of work.

You pay year after year and than when you need them it appears that they are not very helpful. It makes a person wonder. I do have to say though the insurance company I and my husband use has always been real good about paying the claims of another person involved with a accident with me. I have also locked myself out of my car and that is one of the things on the policy is they pay to have your car unlocked. I had this happen to me twice and they reimbursed me what I had to pay to get someone to unlock it. I had the reimbursement in a week also. So not all insurance companies are the same.

After a year and a half they finally paid his medical....the guy ran a stop sign...rammed my sons car....spun it around and rammed it again totaling my sons pickup!!! He had whiplash and still has a bad back. He can't lift hardly anything anymore...hope you brother gets it settled!

sunnflr (695) | 5 months ago | Sorry to hear about your son's accident. I'm glad he finally got it settled correctly. My brother will most likely let it go. He needs the money to get a new car and get back to work. He doesn't have a way of hiring a lawyer and fighting.
