I Live in a Tent ... Here's Why  | |  I got the answer about "Mom's" mother and the reason Mom and Tim cannot move in to the parents' home.
It appears that Mom has a 10-year-old son (handsome boy) from a previous "mistake" as she called it. She also has what appears to be a very evil sister who apparently was unable to have children. She so envied Mom and the fact that she had a son that she and her husband plotted to take the boy away from her.
When Mom and Tim were unable to prove that they could provide a home for the boy, Mom's sister and her husband applied for and were given custody of him. She and her husband were living with her (and Mom’s) parents at that time.
Then the sister got pregnant and had a daughter; she and her husband moved to their own home along with their new infant daughter and Mom’s son.
She apparently hates Mom to such a degree that she told HER mother that if the parents ever allow Tim or Mom to live in their home (where Tim and Mom initially had been living) that she’d never see her (the daughter) or her infant or Mom’s son again.
So Mom’s mother’s hands are tied. She helps them as she’s able to, but she cannot open her home to them again for fear of never seeing either grandchild again.
The situation is very complex. Mom and Tim are hoping that when she is approved for SS disability insurance they’ll be able to rent a three-bedroom home in order to get custody of her son returned to her.
Isn't it amazing how hatred and jealousy can tear families apart, leaving the innocent to suffer?

How can siblings treat each other that way. So Mom, must not have seen her son in a while huh? that is terrible, I hope she is able to keep her unborn child. Surely, whilst she may legally have a protective role for her nephew, should Mom and Tim get themselves back onto an even keel then they could apply for the boy to come to them again. I don't see how in law Mom cannot have access to her own son irrespective of whether she lives in the tent or with her own mother. Of course adoption is a completely different legal matter. Here at any rate.

| rjscott (2639) | 4 months ago | Hiya P1ke ... no, custody and adoption are different. The sister and her husband have custody of the boy. The problem is, they moved out of state since their child was born, and Mom and Tim do not have the resources to travel to see the boy. I don't know if the sister would even permit mother and son visiting, or if she'd be within the law by barring such a visit.
I do know that Tim and Mom can get custody back once they can prove that they have a suitable three-bedroom home: one room for the parents, one for the boy and one for the unborn child.
I'm sure the going will get tougher before it gets better and I'm sure both Tim and Mom are prepared for the challenges facing them. They have spunk and they have heart. I have no doubt they'll win in the end of this story.

| Irishfrndly65 (3311) | 4 months ago |  Usuall, in these cases, it's Managerial Conservatorship that is given to the person seeking 'custody'. Unless stated in the papers, the person or persons with MC can dictate who with and how visitation is done. Even in the case that the parents have visitation, as rj showed, the person with MC can move making it all the more difficult.
We just adopted so I have insight in this. We had to get MC, before we adopted our son because the bio-mom disappearred and was wanted by the authorities. In our case, of course, she had not visitation rights at all. That was for the safety of our son. She still is missing and has several warrants for her arrest. One day I will have to figure out how to explain all that to my wee boy.
